Tutoring Services Agreement

This agreement defines the practical responsibilities of Brightoria Learn, the adult customer, and the learner during a tutoring or learning-support engagement.

Good tutoring is a shared process.

01. Purpose of the agreement

This Tutoring Services Agreement explains the practical relationship between Brightoria Learn, the adult customer, and the learner. It supplements the Terms of Service and applies when a tutoring or learning-support engagement is accepted.

If a booking confirmation or written service proposal contains a specific term that conflicts with this general agreement, the specific confirmed term controls only for that engagement.

02. Parties and responsible adult

The customer is the adult who requests and authorizes the service, accepts financial responsibility, and provides required information. The learner is the person receiving educational support. They may be the same person when the learner is an adult.

For a minor learner, the customer confirms legal authority to arrange the service and remains responsible for scheduling, consent, payment, and appropriate supervision.

03. Educational scope

Available services may include one-on-one academic tutoring, homework and study assistance, personalized learning plans, and knowledge-review sessions. The exact subject, level, session length, frequency, and format are confirmed before the engagement begins.

Brightoria Learn may adjust instructional methods during a session to respond to the learner’s understanding while staying within the agreed general scope.

04. Initial information and assessment

The customer should provide an accurate description of the learner’s current level, goals, relevant deadlines, and known areas of difficulty. Brightoria Learn may review sample work or ask diagnostic questions for planning purposes.

Any initial review is an informal educational assessment only. It is not a clinical, psychological, disability, special-education, or standardized diagnostic evaluation.

05. Personalized learning plan

When purchased, a learning plan may identify goals, recommended topic order, suggested frequency, practice expectations, and review checkpoints. The plan is based on available information and may be revised as new information or progress becomes evident.

A plan does not replace school curriculum decisions, an individualized education program, medical guidance, or a licensed professional’s evaluation.

06. Session preparation

  • Provide relevant instructions, rubrics, notes, attempted work, and permitted materials before or at the beginning of the session.
  • Confirm that files and materials can be lawfully shared and are free from malicious software.
  • Join from an appropriate location with working audio, video when required, and stable internet.
  • Avoid scheduling a session when the learner cannot reasonably participate because of illness, travel, or another known conflict.

07. Tutor responsibilities

The tutor will make reasonable efforts to prepare, explain concepts clearly, adapt examples, invite questions, and encourage independent reasoning. The tutor may identify topics that require additional review and suggest practice.

The tutor is not responsible for controlling the learner’s attendance, completing independent work, enforcing household rules, or guaranteeing that school instructions are accurate or complete.

08. Learner responsibilities

The learner is expected to participate respectfully, attempt problems, communicate confusion, and avoid presenting work completed by another person as their own. Progress is more likely when the learner attends consistently and practices between sessions.

Brightoria Learn may end a session when conduct is unsafe, abusive, persistently disruptive, or incompatible with productive educational support.

09. Parent or guardian participation

For minor learners, a parent or guardian should be available for scheduling and safety matters and should provide an appropriate study environment. Depending on age and platform, the adult may be required to initiate or remain nearby during an online session.

Brightoria Learn may provide the responsible adult with general information about attendance, topics covered, recommended next steps, and concerns affecting service delivery.

10. Academic integrity

Tutoring supports learning; it does not substitute for the learner’s own graded work. Brightoria Learn will explain methods, review attempts, create practice questions, and help organize ideas, but will not take tests, access a learner’s account to submit work, or produce prohibited answers.

The Academic Integrity Policy is incorporated into this agreement.

11. Session timing

A session begins at the confirmed time and ends at the confirmed time. A learner who arrives late may use the remaining reserved period, but the end time is not normally extended. A tutor who causes a material delay will reasonably extend, reschedule, credit, or refund the affected portion.

Breaks may be included when appropriate for the learner’s age, attention, or session length.

12. Technology and interruptions

Both parties should test required technology and maintain a reasonable backup communication method. If a technical problem prevents meaningful instruction, the parties should promptly communicate and attempt a practical solution.

Repeated customer-side technical failures may be treated as missed time when the tutor remained available. Tutor-side or platform-wide failures will normally be handled through rescheduling, credit, or refund for undelivered time.

13. Materials and notes

Brightoria Learn may create session notes, summaries, practice examples, or planning materials. These are for personal educational use and may not be resold, publicly posted, or used to train an automated model without written permission.

The customer remains responsible for obtaining required textbooks, school platforms, and licensed materials unless a written proposal states otherwise.

14. Communication boundaries

Routine communications should relate to scheduling, materials, learning goals, billing, or service administration. Tutors are not required to provide unlimited between-session messaging or immediate responses unless a written package expressly includes that support.

Private tutor contact details should not be requested or distributed outside approved channels.

15. Fees and changes in scope

The confirmed rate applies to the agreed service. Additional preparation, extensive document review, a substantially higher subject level, or new deliverables may require a revised quote before extra work begins.

Payment, cancellation, and refund rules are governed by the corresponding policies.

16. Progress review

Progress may be discussed through learner self-explanation, completed practice, observed confidence, accuracy, consistency, and ability to apply a method independently. Brightoria Learn does not issue official grades or certified evaluations.

Feedback is educational and should be considered alongside information from the learner’s school or instructor.

17. Safety and safeguarding

Brightoria Learn may take reasonable steps to protect a learner from inappropriate conduct or a credible safety concern. The service is not an emergency, crisis, therapy, medical, or child-protection hotline.

If a participant appears to face immediate danger, the responsible adult should contact appropriate local emergency services.

18. End of engagement

An engagement may end when the agreed work is completed, the customer chooses not to book further sessions, availability changes, payment remains unresolved, conduct rules are breached, or Brightoria Learn determines that the requested support is outside its role.

Ending an engagement does not cancel charges for delivered services or completed preparation and does not eliminate continuing privacy, intellectual-property, or confidentiality obligations.
