Terms of Service
These terms establish the rules for using the website and arranging personalized tutoring or learning-support services with Brightoria Learn.
Clear expectations make a better learning relationship.
01. Acceptance of these terms
These Terms of Service govern access to the Brightoria Learn website and the purchase or use of tutoring, homework support, learning-plan, and knowledge-review services. By requesting, purchasing, scheduling, or participating in a service, the customer agrees to these terms and confirms that the information supplied is accurate.
When services are arranged for a learner under the age of eighteen, the contracting customer must be the learner’s parent or legal guardian unless Brightoria Learn has expressly approved another lawful arrangement in writing. The adult customer is responsible for reviewing these terms with the learner in age-appropriate language.
02. Nature of Brightoria Learn services
Brightoria Learn provides supplemental, personalized educational support. Services may include one-on-one explanations, guided practice, homework assistance, study organization, individualized learning plans, and review of previously studied material.
Services are non-certified and are not a school, college, university, accredited program, degree program, examination authority, professional-licensing course, or regulated educational institution. Participation does not create academic credit, a diploma, a certificate of professional qualification, or guaranteed admission to any institution.
03. Eligibility and adult authority
Customers must be legally capable of entering a contract. A person arranging services for a minor represents that the person has lawful authority to make educational, scheduling, payment, and privacy decisions for that learner.
Learners under thirteen must not independently submit personal information through the website. A parent or legal guardian should make the inquiry, provide necessary information, and remain the primary account and communication contact.
04. Service inquiries and acceptance
Submitting an inquiry does not create a booking, guarantee tutor availability, or require Brightoria Learn to accept a requested engagement. A service is accepted only after scope, format, schedule, price, and any required payment are confirmed.
Brightoria Learn may decline a request when the subject is outside available expertise, the requested timeline is not realistic, the requested conduct would conflict with academic integrity, or suitable availability is not present.
05. Scheduling and session format
Sessions may be delivered online using a mutually agreed communication platform. The customer is responsible for a reliable internet connection, suitable device, current software, a quiet environment, and any course materials reasonably needed for the session.
Start times are based on the time zone stated in the booking confirmation. The customer must promptly review time-zone information. A late arrival normally does not extend the reserved end time because another learner may be scheduled afterward.
06. Learner participation and preparation
Effective tutoring depends on active participation. The learner should bring relevant instructions, notes, examples, teacher feedback, and completed attempts when available. The learner should ask questions, attempt practice work, and communicate when an explanation is not clear.
Brightoria Learn may recommend independent practice between sessions. Such recommendations are educational suggestions rather than mandatory school assignments and may be adjusted to the learner’s circumstances.
07. Homework assistance and academic integrity
Homework support is designed to help the learner understand instructions, identify methods, review attempted work, and develop independent problem-solving skills. Brightoria Learn will not impersonate a learner, complete graded work for submission as the learner’s own, take an examination, or help evade academic rules.
If a request appears inconsistent with a school, instructor, testing body, or platform policy, Brightoria Learn may refuse or redirect the activity toward explanation, practice, or review.
08. Learning plans
A personalized learning plan is a practical educational roadmap based on information available at the time of preparation. It may identify goals, topic order, suggested session frequency, and review points. It is not a diagnosis, special-education evaluation, individualized education program, therapeutic plan, or guarantee of results.
Plans may be adjusted as the learner’s needs, availability, school requirements, or demonstrated understanding change. Material changes in scope may require a new quote.
09. Prices, invoices, and payment
Prices displayed on the website are introductory or standard service prices and may change for future bookings. The confirmed price for an accepted booking will be stated before payment or scheduling is finalized.
Customers are responsible for authorized charges, applicable taxes, bank or card-provider fees, and accurate billing details. Additional rules appear in the Payment and Billing Policy.
10. Cancellations and rescheduling
Session time is reserved specifically for the learner. Cancellation, rescheduling, lateness, and no-show rules are described in the Cancellation and Rescheduling Policy. By confirming a booking, the customer accepts those rules.
Brightoria Learn may reschedule or cancel when a tutor is unavailable because of illness, emergency, technical interruption, or another reasonable operational cause. The normal remedy is a replacement time or a refund or credit for the affected undelivered session.
11. Refunds
Refund eligibility depends on whether a service was delivered, whether preparation work was completed, and whether the customer complied with the applicable cancellation period. Details appear in the Refund Policy.
No refund is promised merely because a learner did not receive a desired grade, score, teacher decision, admission result, or subjective outcome.
12. No guaranteed educational outcome
Brightoria Learn will provide services with reasonable care and in good faith, but learning outcomes depend on many factors outside its control, including attendance, prior knowledge, independent practice, school instruction, health, motivation, assessment design, and the accuracy of information supplied.
No statement on the website or during a consultation should be interpreted as a guarantee of grades, test results, completion time, admission, scholarship, graduation, certification, employment, or professional licensure.
13. Tutor and customer communications
Communications should remain respectful, relevant, and appropriate. Harassment, discriminatory conduct, threats, sexual content, repeated boundary violations, or attempts to obtain private tutor information may result in immediate suspension or termination.
For minor learners, Brightoria Learn may require that scheduling, billing, and material decisions remain with the parent or guardian. Session-related updates may be shared with the responsible adult where appropriate.
14. Recording and session privacy
Customers may not record, copy, livestream, publish, or distribute a session without prior written permission from Brightoria Learn and every participant. Brightoria Learn will not routinely record sessions unless a specific arrangement and appropriate consent have been confirmed.
Both parties should protect meeting links, shared documents, learner records, and private communications from unauthorized access.
15. Intellectual property
Brightoria Learn retains ownership of original templates, lesson structures, explanations, learning-plan formats, diagrams, and materials it creates, except where a separate written agreement states otherwise. The customer receives a limited, personal, non-transferable right to use delivered materials for the learner’s own educational purposes.
School textbooks, worksheets, websites, course materials, and third-party resources remain the property of their respective owners. Customers must supply and use such materials lawfully.
16. Acceptable use of the website
- Use the website and forms only for genuine educational and business communications.
- Do not attempt to interfere with security, availability, source code, or another user’s data.
- Do not submit unlawful, infringing, deceptive, malicious, or excessively sensitive information.
- Do not use Brightoria Learn materials to operate a competing repository, resale service, or automated training dataset without written permission.
17. Third-party tools and platforms
Online sessions, payment processing, document sharing, scheduling, or analytics may rely on third-party services. Those providers may apply their own terms and privacy practices. Brightoria Learn does not control every interruption, device incompatibility, or policy change associated with a third-party platform.
When a third-party service is materially necessary, Brightoria Learn will make reasonable efforts to identify the required platform before the service begins.
18. Suspension and termination
Brightoria Learn may pause or terminate access for nonpayment, repeated missed sessions, abusive conduct, academic dishonesty requests, unlawful activity, safety concerns, or a material breach of these terms. Where appropriate, the customer will be told the reason and whether unused prepaid amounts are refundable under the Refund Policy.
The customer may stop purchasing future services at any time, subject to obligations for already confirmed sessions, completed preparation, and outstanding charges.
19. Disclaimers and limitation of responsibility
To the extent permitted by applicable law, the website and educational services are provided without a promise that they will be uninterrupted, error-free, suitable for every learner, or accepted by a particular school or institution. Nothing in these terms excludes rights that cannot lawfully be excluded.
To the extent permitted by law, Brightoria Learn is not responsible for indirect, incidental, special, punitive, or consequential loss arising from educational decisions, missed opportunities, third-party platform failure, or reliance on an expected academic result. Any direct liability will be limited to the amount paid for the specific service giving rise to the claim, except where a different limit is required by law.
20. Governing law and dispute resolution
These terms are governed by the laws applicable in Wyoming, without overriding mandatory consumer protections that apply based on the customer’s location. The parties should first attempt to resolve a concern through a clear written description sent to the appropriate Brightoria Learn email address.
If an informal resolution is not possible, a dispute may be brought in a court with lawful jurisdiction. These terms do not require a customer to waive a non-waivable statutory remedy.
21. Changes and severability
Brightoria Learn may revise these terms to reflect service, legal, security, or operational changes. Revised terms apply prospectively from publication unless applicable law or a specific notice states otherwise.
If one provision is held unenforceable, the remaining provisions continue to apply to the fullest lawful extent. A failure to enforce a provision once is not a permanent waiver.
